RIVERS GOVERNMENT: APPEAL COURT DID NOT REINSTATE AMAEWHULE AND 26 OTHERS

The Rivers State Government has announced that the recent judgment from the Court of Appeal in Abuja did not reinstate the Martin Amaewhule-led faction of the State House of Assembly. The government is moving forward with an appeal to the Supreme Court and has filed for a stay of execution regarding the Court of Appeal’s decision.

In a statement released in Port Harcourt, Attorney General and Commissioner for Justice Israel Dagogo Iboroma, SAN, clarified that Amaewhule and 26 others had defected from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) on December 11, 2023, leading to their automatic loss of seats in the assembly.

Iboroma stated, “On October 10, 2024, the Court of Appeal dismissed Appeal No. CA/ABJ/133/CS/2024, which was filed by the Governor of Rivers State against a previous Federal High Court ruling.”

He outlined the background of the case, noting that the Rivers State House of Assembly had become polarized into two factions following a failed impeachment attempt against the governor. The faction led by Amaewhule filed a suit in the Federal High Court on November 29, 2023, but after their defection in December, the government asserts that their seats became vacant by law.

The Attorney General emphasized that the legality of the defection was not contested in the courts. Instead, the appeals focused on the 2023 Appropriation Law and the role of the National Assembly regarding the legislative functions of the state assembly.

Following the Court of Appeal’s judgment, there has been what Iboroma described as “misrepresentation” regarding the status of Amaewhule and his faction. He urged the public to disregard misinformation suggesting that they remain members of the House of Assembly.

In conclusion, Iboroma affirmed that the governor has directed legal counsel to pursue the appeal and seek a stay of execution to maintain the current status quo in the assembly, urging citizens to be cautious of false narratives circulating in the media.
